Hearing: Comments and Testimony for the Director to Consider Regarding Premium Stabilization and the Necessity of Promulgating a Rule

The Director of the Department of Insurance, Financial Institutions and Professional Registration will hold a public hearing on April 26, 2016 at 9:00 a.m. in Room 520B of the Harry S Truman State Office Building, 301 West High Street, Jefferson City, Missouri.  The purpose of this hearing will be to solicit testimony and comments related to premium stabilization for the property and casualty insurance market in Missouri.

In lieu of or in addition to providing testimony or comments at the hearing, interested parties may also submit written comments.  Such comments shall be submitted no later than 5:00 p.m. CDT on April 29, 2016 and shall be submitted via U.S. Mail, e-mail, or delivered in person as outlined below.

Notice of Hearing

The Missouri Department of Insurance, Financial Institutions and Professional Registration held a public hearing Monday, May 16, 2016 to consider the preacquisition notice (Form E) filed by Aetna Inc., pursuant to Section 382.095 RSMo to acquire Humana Inc. The public hearing was held in Room 520B located in the Harry S Truman State Office Building, 301 West High Street, Jefferson City, Missouri.

Any interested person could provide oral or written comments regarding Aetna’s proposed acquisition of Humana before or after the hearing. Written comments were received through 4:00 p.m., Thursday, May 19, 2016 and the record closed Monday, May 23, 2016.

On May 24, 2016, the Director entered an order finding that the proposed acquisition of Humana by Aetna as to many lines of insurance does not violate Missouri’s competitive standards. However, the Director also found that in its current, unmodified, form – as to a few specified lines of insurance – that the proposed acquisition would violate the competitive standard set forth in Missouri law (§382.095, RSMo), meaning that as to those lines the acquisition would substantially lessen competition in this state.

The Director’s Order is not a final order. The statute provides that Aetna and Humana may submit a plan to remedy the anticompetitive effect of the merger as to those specified lines. Thereafter, the Director would evaluate the plan and may modify or vacate his order.
