Galen Insurance Company (“Galen”) was ordered liquidated on May 31, 2017 by the Cole County Circuit Court, Judgment, Decree and Final Order of Liquidation, Case No. 17AC-CC00005. The Director of the Missouri Department of Commerce and Insurance was appointed Liquidator.
Galen was organized as a Missouri corporation on December 8, 2004, for the purpose of providing medical malpractice insurance to physicians, medical professionals and stand-alone surgical centers on a claims-made basis (Certificate of Incorporation I00626573,NAIC #12361). Galen was first licensed as a property and casualty insurance company in Missouri under Chapter 379, RSMo by the Department on December 14, 2005. Galen was authorized to do business in six states: Illinois, Kansas, Florida, Maryland, Missouri, and New Jersey, but it only wrote policies in Illinois, Maryland, Missouri, and New Jersey. Existing policies terminated 30 days from the date of the Judgment. Claims are now handled by the state guaranty associations in accordance with each state’s guaranty association statute.
Distribution of Assets
Once the Liquidator has marshaled Galen’s assets, the Liquidator will present a plan to the Court to for approval to distribute Galen’s assets according to the distribution schedule set forth in § 375.1218, RSMo. To participate in this distribution, creditors must file a Proof of Claim. The Court set a Claims Bar Date of April 30, 2018. All Proofs of Claim must be post-marked by April 30, 2018. Proofs of Claim post-marked after April 30, 2018 may be treated as late filed claims.
