- AAA Insurance Co., St. Louis, MO, has been ordered to, within 30 days: ensure that its companies' automobile coverage underwriting guidelines do not restrict or prohibit coverage based upon the lawful occupation of the applicant, including military service; ensure that its companies' automobile coverage underwriting guidelines do not restrict or prohibit coverage based solely upon the age of the applicant; ensure that the companies do not limit the time frame within which its policyholders may initiate a lawsuit to a period of time less than 10 years; and ensure that the companies cease using the age of a dwelling as a reason for canceling or nonrenewing a homeowner's policy.
- Missouri Valley Life and Health Insurance Co., Kansas City, MO, was instructed to acknowledge claims within 10 working days of receipt and accept or deny claims within 15 working days after the submission of all necessary forms.
- Clarendon National Insurance Co., has been ordered to, within 30 days: prevent the payment of commissions to an agency without first ensuring that a copy of that agency's current license is on file, ensure it follows its schedule rating plan for workers compensation coverage; cease using and accepting any application that asks if an applicant has been previously cancelled or nonrenewed by any carrier; ensure that all of its applications are signed and all applications contain an alternative method of identifying the agent; ensure that all schedule debits and credits are based on evidence contained in the file; ensure prominent inscription on an endorsement to the insurance contract the limitations of coverage provided by the guaranty association; cease portraying the company's premium discount as being a stock discount; establish and maintain procedures to correctly charge its policyholders the assessment for the Missouri Second Injury Fund; provide the insured with all pertinent information relating to the Missouri Contracting Program; establish and maintain procedures so as to provide a notice of nonrenewal at least 60 days prior to the effective date of the nonrenewal; ensure that it properly endorses its workers compensation policies with an applicable premium discount; cease using schedule rating forms; ensure that evidence is maintained in its policy files; ensure that all audits of its workers compensation policies are completed; billed and premiums returned within 120 days of the policy's expiration or cancellation; ensure that it accurately determines the premium amounts due under its workers compensation policies; ensure that workers compensation claims for temporary total disability benefits are not paid for the first three days or less of disability unless the disability lasts longer than 14 days, ensure that workers compensation claims for temporary total disability benefits are paid every two weeks; and cease conducting business with American Agency Systems Incorporated (AASI) until AASI obtains a certificate of authority from the department as a third party administrator.
- Illinois National Insurance Co., has been ordered to, within 30 days: notify the MDI Director of an appointment or termination of an agent; prevent payment of commissions to an agency without first ensuring that a copy of that agency's current license is on file; and ensure that procedures are in place to allow the company to correctly rate its policies based upon the rating plans filed with the department and documentation in company files.
