- First American Title Insurance Co., Santa Ana, CA, $30,450 forfeiture as a result of the following: soliciting contracts of insurance through individuals who were not licensed as title insurance agents, failing to issue its contracts of insurance in accordance with sound underwriting practices - (a) utilized a date other than the recording date for the insured transactions as the effective date of the policy; (b) agents failed to record documents which created the insured interest in real estate within three business days of closing and disbursements; (c) issued contracts of insurance in reliance upon affidavits and indemnity agreements which were incomplete, inconsistent or did not name First American as a party; and (d) including exceptions to coverage without reference to a creation document or other evidence which created the need for the exception to coverage, failing to acknowledge pertinent policy claim communications with reasonable promptness when handling claim settlements, and failing to maintain its claim files with such detail so that pertinent events and dates could be reconstructed.
- Old Republic Title Insurance Co., Minneapolis, MN, $20,675 forfeiture as a result of the following violations: failing to issue its contracts of insurance in accordance with sound underwriting practices utilizing a date other than the recording date for the insured transactions as the effective date of the policy and some agents included exceptions to coverage without reference to a creation document or other evidence which created the need for the exception to coverage; failed to acknowledge pertinent policy claim communications with reasonable promptness when handling claim settlements and failed to affirm or deny coverage of claims within a reasonable time.
